These Terms of Use (“Terms”) govern your access to and use of the Virginia Wine Market website, including any content, features, and services offered at vawinemarket.com and any related subdomains (collectively, the “Site”). The Site is operated by Wine Market Ventures (“Virginia Wine Market,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (collectively, this “Agreement”). If you do not agree, you must not use the Site.

1. Eligibility and Responsible Use

The Site provides information and content related to wine and alcoholic beverages. By using the Site, you represent and warrant that:

• You are at least 21 years of age, or the legal drinking age in your jurisdiction, whichever is greater.
• You have the legal capacity to enter into this Agreement.
• You will access and use the Site in compliance with all applicable laws and regulations.

We do not promote excessive or irresponsible consumption of alcohol. If you choose to consume alcohol, you do so at your own risk and agree to do so responsibly and in accordance with applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIRGINIA WINE MARKET, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS, OR ANY OF THEIR RESPECTIVE OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE;

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRGINIA WINE MARKET’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US, IF ANY, FOR USE OF THE SITE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES OR IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless Virginia Wine Market, its affiliates, licensors, and service providers, and their respective owners, officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of.
